Our Contract with You
How We Accept Your Order. By placing an order, you agree that your order constitutes an offer to purchase all the products and services listed in your order according to these terms. All orders must be accepted by us, and we are not obligated to sell products or services to you. We may, at our discretion, decide not to accept an order. Your order is considered accepted by us when we send you a confirmation email. From that point, a contract is formed between you and us.
What Happens If We Cannot Accept Your Order? If we are unable to accept your order, we will inform you in writing and will not charge you for the product. Reasons we may not be able to accept an order include: the product is no longer available, incorrect or unverifiable billing details, errors in pricing or product descriptions, or the inability to meet a delivery deadline you specified.
Your Order Number. We will assign an order number to your order, which we will communicate to you once we accept your order. If you contact us regarding your order, it will be very helpful to provide your order number.
Products Not for Resale or Export. You affirm and guarantee that you are purchasing products or services from the website solely for your personal or private use, and not for resale or export.
Price and Payment
Where to Find the Price of a Product? The price of the product (including all taxes such as VAT) is the price displayed on the order pages at the time of your order. All prices, discounts, and promotions published on this website are subject to change without prior notice.
What Happens If We Display an Incorrect Price? We make every effort to ensure correct pricing. However, despite our best efforts, some products may display an incorrect price. We reserve the right to correct any errors, inaccuracies, or omissions at any time and cancel orders resulting from such issues. We usually check prices before accepting your order, so if the correct price of the product is lower than the price indicated at the time of your order, we will charge the lower amount. If the correct price is higher than what was initially indicated, we will ask for your instructions before accepting the order. If we accept and process an order containing a clear pricing error that you could have reasonably identified, we have the right to cancel the contract, refund all amounts paid, and request the return of any products delivered.
When and How You Must Pay? You must pay for the products before we dispatch them. We accept payments via MasterCard, Visa, PayPal, Apple Pay, Google Pay and Klarna. You confirm and warrant that (I) the credit card details you provide are true, correct, and complete, (II) you are duly authorized to use this card for the purchase, (III) the charges you incur will be accepted by your card issuer, and (IV) you will pay the costs incurred, including shipping and handling fees, taxes, and any additional charges, regardless of the amount displayed on the website at the time of your order.
Delivery of Products
Delivery Exclusion. Delivery is available only within Austria.
Delivery Costs. Delivery costs will be displayed on our website. The prices listed do not include shipping and handling fees. These additional fees will be added to the value of your goods and will be displayed in your cart and order confirmation email.
When We Deliver the Products. During the order process, we will inform you of the delivery date of your products.
Delays Beyond Our Control. We are not responsible for delays outside our control. If the delivery of our products is delayed due to events beyond our control, we will inform you as soon as possible and attempt to minimize the impact of the delay. In the event of a prolonged delay, you may contact us to cancel the contract and receive a refund for any products not yet delivered.
If You Fail to Arrange for Re-delivery. In the event that you are not present to receive the delivery and the products do not fit in your mailbox, the courier is expected to leave a notification providing instructions on how to arrange a re-delivery or collect the products from a nearby pickup depot. If you do not arrange for re-delivery or fail to collect the items, we may cancel the contract.
Your Rights in the Event of Late Deliveries. If we deliver products late, you have certain legal rights. If we fail to meet the delivery date for a product, you may treat the contract as void if one of the following applies:
- We have refused to deliver the products,
- The delivery was of substantial importance (considering all relevant circumstances), or
- You informed us in advance that timely delivery was essential.
Responsibility and Ownership of Products
When You Take Responsibility for the Products. You are responsible for the products once we have delivered them to the address you specified.
When You Own the Products. You become the owner of the products once we have received full payment.
Returns
Right to Return Purchases from Skechers Website. For all purchases made through our online store, we grant consumers a return right of 45 days from the date of receipt of the goods. You may return unworn products within 45 days and receive a refund, provided you follow the instructions below.
Your statutory right of withdrawal remains unaffected by this return policy and is in addition to the rights stated here. This means that as a consumer, you have the right to withdraw from the purchase within the withdrawal period and under the conditions specified, without adhering to the rules of this return policy.
This return right does not limit your legal warranty rights, which remain fully intact.
How to Request a Refund. To return an order and request a refund, download the return form from your Skechers account on www.skechers.at "MY ORDER" or via the order status link in the shipping confirmation email, and complete the form. Please send the completed form to the address indicated on the form. Further information is available in our return policy.
Please use the shipping label provided to return the order. Ensure that the tags on the goods are not removed and return the shoes undamaged in their original box.
Please note that returns from the Skechers online store cannot be made in Skechers retail stores and the other way around.
When We Bear the Cost of Returns. We will cover the cost of returns.
How You Will Receive Your Refund. If you follow the instructions above, we will refund the price you paid for the products. The refund will be processed using your original payment method. In some cases, we may deduct a specific amount from the refund.
How the Refund is Processed. The refund will be made within 14 days from the date we receive the returned goods. Upon the return of the products and payment, the contract is considered terminated.
Warranty. Skechers is liable for defects in the goods under applicable legal provisions. Warranty claims are void for damages resulting from improper handling and use of the goods.
To report a defect, please complete the form available in your Skechers account or through the order status link (after shipping) on the Skechers website and send it to the address provided on the form.
Our Rights to Terminate the Contract
We may terminate the contract if you breach its terms. We may terminate the purchase contract for a product in the following cases:
- If you fail to pay for the products on time and have not done so within 14 days after we reminded you,
- If you make it impossible for us to deliver the products within a reasonable period.
Our Responsibility for Loss or Damage
In no case shall we be liable for consequential, indirect, incidental, special, exemplary, punitive, or enhanced damages, loss of profits or revenue, or depreciation arising from or related to any breach of these terms, whether or not such damages were foreseeable, whether or not we were informed of the possibility of such damages, and irrespective of the legal or equitable theory (contract, tort, or otherwise) under which the claim is made.
Our total and sole liability, for any reason, and your sole and exclusive remedy, is limited to the actual amount you paid for the products and services you ordered through our website.
The above limitation of liability applies:
- (I) only to the extent permitted by law, and
- (II) does not apply to (A) liability for gross negligence or willful misconduct on our part, or (B) injury to life or body due to our actions or omissions.
Force Majeure. We shall not be liable or responsible for, nor shall we be considered in default or in breach of these terms due to any delay or failure in performance caused by events or circumstances beyond our reasonable control, including but not limited to acts of God, floods, fires, earthquakes, explosions, governmental actions, war, invasion or hostilities (whether declared or not), terrorist threats or acts, riot or civil disorder, national emergency, revolution, insurrection, epidemic, pandemic, strikes or other labor disputes (whether or not involving our workforce), or delays or restrictions affecting transportation companies, or the inability or delay in procuring adequate or suitable materials, telecommunication failures, or power outages.
No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of Skechers.
No Third-Party Beneficiaries: These Terms are not intended to confer any rights or remedies to any person other than you.
Assignment: You will not assign any of your rights or delegate any of your obligations under these Terms without our prior written consent. Any purported assignment or delegation that violates this paragraph is null and void. No assignment or delegation relieves you of your obligations under these Terms.
Severability: If any provision of these Terms is invalid, illegal, void, or unenforceable, that provision will be considered severed from these Terms and will not affect the validity or enforceability of the remaining provisions.
Entire Agreement: Our order confirmation, these Terms of Sale, our website Terms of Use, and our Privacy Policy are considered the final and integrated agreement between you and us regarding the matters contained in these Terms.
Alternative Dispute Resolution: Alternative dispute resolution is a process where an independent body considers the facts of a dispute and attempts to resolve it without court action. You can find the EU Online Dispute Resolution (ODR) platform here. We are not obligated to participate in alternative dispute resolution and do not currently participate in it.
